Appellant Frank Trinidad was found guilty by a jury for the offense of murder and assessed punishment at life imprisonment in the Institutional Division of the Texas Department of Criminal Justice. Trinidad asserts on appeal that the evidence is legally and factually insufficient, and that the trial court erred in allowing the alternate juror to be present for the jury deliberations. Although we hold that the evidence is legally and factually sufficient, the alternate jurors presence violated Article V, Section 13 of the Texas Constitution, and we, therefore, reverse the judgment of the trial court and remand this matter for proceedings consistent with this opinion.
